			<content:encoded><![CDATA[<p>During the last six months there has been significant turmoil in Greece as the Government comes to terms with their excessive debt load.  It is arguable that the debt load and government crisis is due in large part to the government unions.  Why does a government work force need a union.  Unions were originally established to help the workers defend themselves against excessive demands and poor working conditions.  Unions were very effective during the industrial revolution and could serve a purpose in developing countries such as China and India.  However, they do not serve a valuable purpose in government.  Unless you think that the government is dangerous and will treat their employees unfairly etc.  The irony is, these people are so dependent upon the government that they don&#8217;t know what to do now that their government is broke.</p>

<p>So I have a business and accounting background.  I see the government as a necessary part of a business called general &amp; administrative.  On the financial statements this is a set of expenses that is &#8220;below the line&#8221;.  As such the G&amp;A generally provides support to the overall business, provides services such as accounting and regulatory compliance, but generally does not generate any revenue.  Think of a company such as Microsoft, trying to sell a business the right to use their marketing department, or accounting department.  It just doesn&#8217;t make sense.</p>
<p>Now to continue the metaphor, the income generating portion of the business (in Microsoft&#8217;s case, the sale of software and hardware) is like the private companies that generate GDP and pay taxes.  This portion of the business is what &#8220;brings home the bacon&#8221; so to speak.  It makes it possible for the G&amp;A to even exist.  You couldn&#8217;t have an accounting department without the income generating portion of the business.</p>
<p>If the income generating portion of the business begins to struggle to earn income because market conditions change, or capital is unavailable etc, the answer isn&#8217;t to hire more accountants and lawyers.  If a business were to report that they are growing because despite a loss in revenue they hired more accountants and therefore economic activity is up, that would be ludicrous.  The answer is to trim the business fat, focus on what drives income, and what the competitive advantage is, and then do it.</p>
<p>So backing out of the metaphor, the current situation in our country cannot be fixed by hiring more government workers.  If so we&#8217;ll just end up like Greece, bankrupt with no one to pay the taxes.  We need to trim the fat of G&amp;A, focus on what drives true economic activity, and let businesses prosper.</p>

<p>In the above section it is clear that the President does have the authority per the Constitution to &#8220;recommend to their Consideration such Measures..&#8221;.  Ultimately this becomes a judgment call as to what the definition of recommend is.  Recent administrations have &#8220;recommended&#8221; entire bills that they have written or crafted.  It seems that the President should encourage congress to consider serious issues and to seek a solution that best serves the interest of the American people.  Oddly enough it might seem that the current administration took this tack with the Health Care overhaul.  The author feels that while the tack may have been technically appropriate, the failure is more in the conclusion reached than in the recommendation.</p>
<p>Other items in this section seem fairly standard and are practices with which the average American is familiar.  The annual state of the union is something that is analyzed and reviewed, where the President list&#8217;s his agenda for a year just after saying that the &#8220;state of the nation is &#8217;strong&#8217;&#8221;.  I find that statement ironic considering the list of items they feel need to be corrected.</p>

			<content:encoded><![CDATA[<p>Freedom is a God given right, and the oppressive  evil which is becoming our government is of the devil. The government today is here to tell you what to do, when to do it, and there should be no questions asked. The history of the world and the history of our beautiful country proves that we the <span style="text-decoration: underline;">PEOPLE</span> are meant to be free. We need to WAKE-UP!!! We are missing out on great opportunities to spot our loss of rights and freedom, and the time is NOW to get up and fight for the God given liberties that we were born with. As the Prophet John had said, &#8220;And ye shall know the truth, and the truth shall make you free.&#8221; (John 8:32) God wants us to wake up, he wants us to learn all we can, so that we can further the power of truth. We all must under stand the great importance of education, we need to spend time talking to our friends and our neighbors. Spread the word, help other people wake up and realized what this terrible act of tyranny is commencing on our own soil. A true American hero once said,&#8221;the constitutions of most of our states (and of the United States) assert that all power is inherent in the people; that they may exercise it by themselves; that is it their right and duty to be at all times armed; that they are entitled to freedom of person, freedom of religion, freedom of property and freedom of the press.&#8221; (Thomas Jefferson) Please read that three of four times if you really need to&#8230; Now reflect on the United States now. What do you think?</p>
<p>Obama is making a change yes a change to communism. This is not a conspiracy, this is a fact. The powers of the government these days has grown out of our hands. The federal government is now controlling the economy, our health, our minds. We are subject to these evils because we allow ourselves to be consumed with the heard of sheeple. Sheeple go home turn on the TV and tune out, while billions of dollars are being flashed in front of our eyes and eventually we began to strive to be like our favorite Television shows. We lose ourselves and our minds and, eventually forget our GOD given freedoms. Now believe me it is hard to believe that Television is controlling you, but it is your duty to go and find the REAL answer. I would rather you do not believe me and do research on these things. Statistics show that &#8220;the average American watches more            than 4 hours of TV each day (or 28 hours/week, or 2 months of nonstop            TV-watching per year). In a 65-year life, that person will have spent            9 years glued to the tube.&#8221; (www.csun.edu) That is a scary fact.</p>
<p>So its not just the scholars duty to wake up and realize these things, it is our duty as individual human beings to expand our mind to learn and to read. Stay informed! Do not waver in disbelief, sit down and find your own truths. Listen to the truths of our past, our heritage, there is a reason why the government wants you to be distracted. Those should be our main focuses especially since they blind us with profit, and hide the facts of the loss of rights. Obama is turning our country upside down. We cannot just sit and watch it happen, we cannot just sit at home while we become enslaved! A very dear hero of mine recorded, &#8220;And under this head ye are made free, and there is no other head whereby ye can be made free.  There is no other  name<a title="Gal. 3: 27; Mosiah 1: 11; Mosiah 26: 18." type="A" href="http://scriptures.lds.org/en/mosiah/5/8c"></a> given whereby salvation cometh; therefore, I would that ye should take upon you the name of Christ, all you that have entered into the covenant with God that ye should be obedient unto the end of your lives.&#8221; (Mosiah 5:8) Stop letting the news tell you who is good, or bad. Listen to yourselves God gave you a brain to think. Not to let other people think for you.</p>
<p>Now let us make a promise today that we will go and find the truths. Find out your real freedoms, read the constitution. (THAT IS WHAT THIS WEBSITE IS FOR!!!) Well these are important questions we <span style="text-decoration: underline;">ALL</span> need to be asking ourselves. Our government is no longer listening to its people, we are losing our voices. And if we do not learn to stand up for ourselves and for future generations, we will wake up in a Soviet Communistic state.  Now I don&#8217;t know about you but I&#8217;m not going to sit and watch this evil unfold.</p>
<p>I know all of you left-wing, liberal, socialist nuts are saying, &#8221; Now what about all of the people the government is helping with the Health care Bill?&#8221; HA! Well first Obamacare is a freedom killer, and if you want the government to decide; what drugs you will take, which doctors to see, if you will even be covered, ect&#8230; Then congratulations you will be one of those millions of Americans will be lining up at a government hospital waiting to POSSIBLY be seen by a barley qualified government doctor. Well that is your future, but not mine. &#8220;But what about the people living in poverty they are now receiving health care? You are racist for demoting Obama&#8217;s Health Care.&#8221; That is exactly a Socialistic thought, okay so maybe some lazy homeless guy is now getting doctor attention, but now every noble hardworking American is going to pay $8,125 per person per year. Ouch&#8230; I barely make that anyways why am I paying for people who do NOTHING?! And what about all of those homeless people that are homeless because they are criminals, or drug addicts? Congratulation&#8217;s your socialist power upheaval is helping a lot of great people. So what about all of us other Americans? Where is our break? We will not get one, in fact there will only be more taxes for those of us who actually work hard to put food on our tables. But wait doesn&#8217;t that sound familiar?</p>
<p>Lets take a look at our great history, in 1764 the all great British government decided to start taxing our sugar and our currency. But our courageous founding fathers chose not to stand for the, now this is important, <strong>TAXATION WITHOUT REPRESENTATION</strong>. A years go by and the British government chose to ignore the people, and continued to tax the people. That is when our founding fathers stood up for their GOD given rights, and on 1773 they decided to show their distaste. Fast forward to today looks like deja Vu to me.</p>
<p>My fellow American people, we need to stop separating ourselves by race and gender. We need to unite as a Nation under God, and we need to fight for our liberties. We cannot just sit here and expect other people to do this for us we are the generation that needs to be there to fight this communistic idealism. Please remember our history, remember that we were a nation that was founded under God, and that originally all people were created equal. Do not forget the past because history has a tendency to repeat its self. Obama <strong>IS</strong> taking your freedoms with every bill. He <strong>IS </strong>trying to divide our nation so that the people will fight each other and ignore the tyrannical overthrow. We are the generation under our founding fathers who are set to the same task to oppose communisim, and to return the powers of the government to its rightful place. UNDER THE PEOPLE. Now if you have made it this far past all of my grammatical errors I applaud you. And now I will give you the duty to inform yourself, your neighbors, and your friends of the evils that are setting foot in our God given nation. I am praying for you and for all Americans to <span style="text-decoration: underline;"><strong>WAKE UP</strong></span>!!!!</p>

			<content:encoded><![CDATA[<p>President Obama turned an otherwise tepid State of the Union address into a newsfest with his controversial critique of the Supreme Court&#8217;s recent decision overturning parts of a 63 year-old law.  In fact, President Obama could not &#8220;think of anything more devastating to the public interest&#8221; and went on to suggest that the ruling could jeopardize his domestic agenda.  However, the real issue is not whether corporations can inflate campaign coffers and essentially &#8220;win&#8221; an election for their candidate, but whether the President&#8217;s place is to criticize the Court&#8217;s decision. </p>
<p>He called the decision &#8220;unacceptable&#8221;; however, more likely it was his response that was unacceptable.  Presidents&#8217; clash with the Supreme Court is nothing new.  In fact, presidential opinions on the subject date back to the days of Thomas Jefferson and extend down to George W. Bush.  Nevertheless, it was Obama&#8217;s handling of the situation and his peculiar timing that created the real controversy.  Past presidents issued written statements of disagreement or responded with an opinion when asked; nevertheless, our current President found the need to single out a neutral party - the Supreme Court. </p>
<p>Former New Jersey Supreme Court Justice, Peter G. Verniero put the public&#8217;s concerns with the President&#8217;s comment perfectly: “The court’s legitimacy is derived from the persuasiveness of its opinions and the expectation that those opinions are rendered free of partisan, political influences,” he said. “The more that individual justices are drawn into public debates, the more the court as an institution will be seen in political terms, which was not the intent of the founders.”  In short, the President&#8217;s actions were not wrong because he disagreed with the Court, but because he politicized the Court in a way that undermines its effectiveness and influence.  I recently heard a state supreme court justice speak and say the U.S. Supreme Court or any state&#8217;s supreme court is final not because it&#8217;s right but right because it&#8217;s final.  The Court&#8217;s obligation is to follow the law in a neutral non-partisan way.  The real concern is whether the President actually wants the Court to fulfill its obligation or his political agenda.</p>

<p>He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.&#8221;</p>
<p>Much of what is laid out above is familiar to most Americans.  We recognize the President as the Commander in Chief, as one having the ability to pardon, and as one who nominates ambassadors and supreme court justices.  One of the more controversial issues today is the President&#8217;s ability to appoint &#8220;inferior Officers&#8221;, which we now know as Czars.  President Obama has decided to name his inferior appointments Czars.  This name seems counter to the spirit of Americanism.  It is the opinion of the author that the President should not use this title for these appointments.  Additionally, the constitution does allow the President to make inferior appointments without consent of congress; however, President Obama has taken this privilege to a new level.</p>
<p>For example the President has at least 32 Czars; many of which have responsibilities that could be managed by departments already in existence, with leaders who are approved by the Senate.  It almost appears that President Obama is attempting to operate within the technical writing of the constitution, but is ignoring the spirit of the writing in the constitution.</p>

<p>Article II is about the executive branch of the the U.S. Government.  At the time of this writing, Barack Obama is currently the President and has been duly elected in the manner set forth in the Section 1.  There has been much debate with regards to the system known as the &#8220;Electoral College&#8221;.  For example, in 2000 the popular vote was in favor of Al Gore, but the Electoral College vote favored George W. Bush.  This was due primarly to a &#8220;winner take all&#8221; assumption in each state. </p>
<p>It is the feeling of the author that ultimately there are some significant advantages to the electoral college that make it preferential over any other system.  Let me use a game of numbers to explain:</p>
<p>Let&#8217;s suppose the U.S. did not have the electoral college and that the President was determined by a series of run-off elections.  Meaning that there were multiple rounds of elections and ultimately when a majority of the country voted for 1 candidate then that candidate was the president.  Let&#8217;s begin with 10 candidates 4 from &#8220;majority parties&#8221; such as the Democratic Party or Republican Party and 6 from alternative parties, such as the Communisty Party, Independent Party, Socialist Party, Constitutional Party, Green party, etc.  Now let us assume that the 4 from the &#8220;majority parties&#8221; split their voters and that the Communist Party acquires 15% of the vote and that this is the most votes for one candidate.  Followed by 12% for the Socialist party, 10% for the green party and 4 or 5% for all the remaining candidates.  The field is eliminated to the top 4 candidates and we are left with no single candidate from a &#8220;majority party&#8221;.  The country elects a candidate that is ultimately only representing 10% or less of the population.  This is not majority rule as intended but rather minority rule. </p>
<p>Now let&#8217;s review this scenario from the perspective of the current system.  First, no party presents more than 1 candidate, thus eliminating a party split.  Second, the winner of a state is awarded the entire states electoral votes, thus encouraging a focus on winning a majority in each state.  As such it is very unlikely for a party&#8217;s candidate that represents only a small portion of the general population to actually win the election, thus preserving the rule of the majority.</p>

<p>No state shall, without the consent of the Congress, lay any imposts or duties on imports or exports, except what may be absolutely necessary for executing it&#8217;s inspection laws: and the net produce of all duties and imposts, laid by any state on imports or exports, shall be for the use of the treasury of the United States; and all such laws shall be subject to the revision and control of the Congress.</p>
<p>No state shall, without the consent of Congress, lay any duty of tonnage, keep troops, or ships of war in time of peace, enter into any agreement or compact with another state, or with a foreign power, or engage in war, unless actually invaded, or in such imminent danger as will not admit of delay.&#8221;</p>
<p>The above section of Article 1 is actually quite fascinating considering what occurred this year in California.  California paid debts not with gold or silver, and not with Federal Reserve notes, also known as Dollars.  Could it be argued that the State of California violated the Constitution of the United States when they satisfied their debts with I.O.U&#8217;s?</p>
<p>Also it is important to understand that the founders were interested in trying to maintain a careful balance between State&#8217;s rights and Federal rights.  The founders were weary of totally independent states, which was the case leading up to the formation of the Constitution.  However, it is important to understand that the best kind of government is local government, where the people who make the decisions are close to those for whom they make the rules.</p>

It&#8217;s a very long bill.  As a quick tid-bit the bill is set to kick into effect 2012.  This would allow President Obama to obtain his second term before the bill starts to raise taxes on every man woman and child in the United States.  This despite the President&#8217;s promise to NOT raise taxes on any one making less than $250,000.</p>
